PIP Miami

If someone’s negligence caused your injury in a Miami car accident, let Shamis & Gentile, P.A. help you get your medical bills paid.

If you are covered by Personal Injury Protection (PIP), it pays benefits regardless of whether you are at fault. Even if you were at fault (or received a ticket for a moving violation) for causing the auto accident, PIP will still pay your medical bills so long as they are related to the accident.

How much of my medical bills does Miami PIP cover?
If you were hurt in a motor vehicle accident and you’re covered by Miami PIP, then the minimum limits for no-fault PIP benefits are:

$10,000 for Medical Bills
$10,000 per person for loss resulting from bodily injury, sickness, or disease arising out of the ownership, maintenance, or use of a motor vehicle if a physician, dentist, physician assistant, or advanced registered nurse practitioner has determined that the injured person had an emergency medical condition;

$2,500 for Medical Bills if You Don’t Have an “Emergency Medical Condition”
$2,500 per person for loss resulting from bodily injury, sickness, or disease arising out of the ownership, maintenance, or use of a motor vehicle if a physician, dentist, chiropractic physician, physician assistant, advanced registered nurse practitioner, physical therapist or person licensed to provide emergency transportation and treatment has determined that the injured person did not have an emergency medical condition. However, insurance companies will often deny your claim stating that you don’t have an emergency medical condition even though you have the correct documents!

Provide Miami PIP Information to Your Medical Providers
It is important that you give the proper PIP claim information to all of your medical providers. Otherwise, the PIP insurer may argue that they do not have to pay your health insurer or any other of your first party insurers who pay your bills.

Miami PIP Pays 80% of Reasonable Medical Bills (unless otherwise stated in your policy)
PIP medical benefits pays 80 percent of all reasonable expenses for medically necessary medical, surgical, X-ray, dental, and rehabilitative services, including prosthetic devices and medically necessary ambulance, hospital and nursing services.

Medical benefits are only paid by PIP if you receive initial services and care within 14 days after the motor vehicle accident.
