In the News: Law360, New York (December 1, 2017, 3:54 PM EST) In early November, attorneys at Shamis & Gentile P.A. filed a class action lawsuit against Lyft Inc., developer of the popular ride hailing app, and Jobcase, a social network for job seekers and employers, alleging that the companies violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited spam text messages in an attempt to recruit potential Lyft drivers.
Only three weeks after filing the initial complaint in Federal Court, a Florida federal judge set a trial date for September 2018 and ordered the parties of the suit to attempt to resolve the matter via third-party mediation.
Under the TCPA, penalties for violations can range between $500 and $1,500 per violation. The lawsuit estimates that the incidence of violations in this case could be in the thousands. According to the court order, mediation must be completed by May 30, 2018.
The proposed class is represented by Andrew Shamis and Angelica Gentile of Shamis Gentile, P.A., Scott A. Edelsberg, Jeff Ostrow and Avi R. Kaufman of Kopelowitz Ostrow Ferguson Weiselberg Gilbert, and Manuel Hiraldo of Hiraldo PA.
The case is Fente et al. v. Jobcase et al., case number 1:17-cv-24082, in the U.S. District Court for the Southern District of Florida.
