How Do They Work?

In most instances, those involved in the class action lawsuit will not take place in the proceedings directly unless, of course, they have valuable evidence to present to the court. A Lead Plaintiff is often selected instead – this being one of the individuals who initially complained about the issue and who represents the majority of the other complainants. The Lead Plaintiff is the person who consults directly with the class action lawyers in an effort to plan a strategy for the case. The Lead Plaintiff will also be involved in the process of deciding whether to accept or reject a settlement offer. The other individuals involved will usually not have a say when it comes to any decisions relating to a settlement.

If and when a settlement is reached, the court will be responsible for deciding how the stipulated amount will be divided among the members of the class action lawsuit. Depending on his or her overall involvement in the case and court proceedings, the Lead Plaintiff will often receive a larger sum.
