Breach of Contract Lawyer | Shamis & Gentile, P.A.
Every successful business needs enforceable contracts. To ensure that success, companies usually have someone with great experience draft a contract where each party’s responsibilities and requirements are clearly set forth. This contract lets each party know what is expected out of the other party. Shamis & Gentile, P.A. has years of experience drafting and review business contracts. Do you need a contract lawyer to review a business contract?
Written contracts are not the only kind of contracts that are legally enforceable. There are also verbal contracts that are just as enforceable as a written contract. These are often less known to the general public than a written contract.
Please note that even when any transaction (a purchase, a promise to perform, etc.) is sealed with a contract (think: signing at the bottom), there is no guarantee that disputes will not arise in the future because one of the parties’ did not live up to their part of the bargain. A party is in breach of contract when it fails to do something they agreed to do in the contract or does something they promised not to do. This usually is easy to identify because one of the parties feels “wronged.” Similarly, a party’s failure to pay for goods delivered or services rendered may result in a breach of contract. Also, a breach of contract occurs when a party provides inferior or substandard merchandise, or fails to deliver goods on time. For example, you ordered that brand new mustang, but instead of the 2015 model they send a 2014.
If someone’s breach of contract caused you or your company to lose money, the contract litigation attorneys of Shamis & Gentile P.A. have the experience and resources necessary to help recover the money you lost. Please note that the harm caused by the other party to you or your company may not be only financial in nature. For example, if the breach involved real property or artwork, the remedy may not be an award for monetary damages, but the specific performance of the agreement, i.e., the delivery of the artwork or real property in question. If you paid extra money to get a unique item, we will aggressively litigate to get you that specific item.
Similarly, if someone else is suing you for an alleged breach of contract and you were justified in not performing the duties that party claims you were contractually obligated to perform, we can help you protect your rights.
